Terms of Service

1. Operator and Acceptance of Terms
IVTTV is operated by Media4you Internet Services GmbH, registered in the Austrian commercial register (Firmenbuch) under FN 417450y, with its registered office at Handelskai 94-96, Millennium Tower, 1200 Wien, Austria ("we", "us", "the Operator"). By accessing or using the IVTTV platform and its associated services at ivttv.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Media4you Internet Services GmbH.
2. Description of Service
IVTTV is a streaming platform that provides access to live television channels, movies, TV series, live sports events, and other audiovisual content. The Service is offered in several subscription tiers (including IVTTV 4K, IVTTV HD, and IVTTV Mobile) with varying features regarding video quality, number of simultaneous streams, and supported devices. Content availability is subject to territorial licensing restrictions. Teleprog content is licensed for Austria, Germany, and Switzerland. Globo content is licensed for Austria, Slovenia, and Liechtenstein. The Service is provided as a distance contract for digital content within the meaning of the Austrian Fern- und Auswaertsgeschaefte-Gesetz (FAGG).
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate, complete, and current information during registration and keep your account data up to date. You must be at least 16 years of age to create an account. Media4you Internet Services GmbH reserves the right to suspend or terminate accounts that violate these Terms or applicable law, upon reasonable notice where practicable.
4. Subscriptions and Payments
Paid subscriptions are billed on a recurring basis (monthly or yearly) as selected at the time of purchase. All prices displayed on the Service include the applicable value-added tax (currently 20% in Austria). You may cancel your subscription at any time; your access will continue until the end of the current billing period. We reserve the right to change subscription prices with at least 30 days' prior written notice. If you do not agree to a price change, you may cancel before the new price takes effect. Refunds are handled in accordance with the Austrian Konsumentenschutzgesetz (KSchG) and the EU Consumer Rights Directive. Payment processing is handled by third-party payment service providers; we do not store your complete payment card details.
5. Content and Intellectual Property
All content available on IVTTV, including but not limited to live television streams, movies, series, graphics, trademarks, logos, and software, is owned by or licensed to Media4you Internet Services GmbH and is protected by Austrian and international copyright and intellectual property laws, including the Austrian Urheberrechtsgesetz (UrhG). Your subscription grants you a limited, non-exclusive, non-transferable, revocable right to stream content for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, publicly perform, create derivative works from, or otherwise exploit any content without prior written consent from the rights holder.
6. Acceptable Use
You agree not to: (a) share your account credentials with third parties or allow multiple persons to use a single account beyond the number of simultaneous streams permitted by your plan; (b) use VPNs, proxies, or other tools to circumvent geographic or territorial licensing restrictions; (c) attempt to download, record, capture, or redistribute any content from the Service; (d) reverse-engineer, decompile, or disassemble any part of the Service or its digital rights management protections; (e) interfere with or disrupt the operation, security, or infrastructure of the Service; (f) use the Service for any purpose that is unlawful under Austrian or European Union law. Violations of this section may result in immediate account suspension or termination and potential civil or criminal liability.
7. Availability and Modifications
Media4you Internet Services GmbH strives to provide uninterrupted access to the Service but does not guarantee availability at all times. Scheduled maintenance, technical disruptions, force majeure events, or content licensing changes may temporarily affect availability. We may modify, update, or discontinue features of the Service at any time. If a material change negatively affects your subscription, you will be notified in advance and may cancel without penalty. Content availability varies by territory and is subject to the licensing restrictions described in Section 2.
8. Limitation of Liability
To the extent permitted by applicable Austrian and EU law, Media4you Internet Services GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Our total aggregate liability for direct damages shall not exceed the subscription fees you have actually paid to Media4you Internet Services GmbH in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited by mandatory Austrian or EU consumer protection law.
9. Termination
Either party may terminate this agreement at any time. You may terminate by cancelling your subscription through your account settings or by contacting support@ivttv.com. Media4you Internet Services GmbH may immediately suspend or terminate your access if you materially breach these Terms. Upon termination, your right to access the Service ceases at the end of your paid billing period (or immediately in case of termination for breach). Sections relating to intellectual property, limitation of liability, and governing law survive termination.
10. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes at least 30 days before they take effect, via email to the address associated with your account or through a prominent in-app notice. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you may cancel your subscription before the changes take effect.

12. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Austria, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Vienna, Austria. However, if you are a consumer within the meaning of the Austrian Konsumentenschutzgesetz (KSchG), you may also bring proceedings before the court of your habitual residence within the European Union, as guaranteed by Regulation (EU) No 1215/2012 (Brussels Ia). Mandatory consumer protection provisions of the country in which you are habitually resident shall apply to the extent that they provide a higher level of protection.
13. Right of Withdrawal (14-Day Cooling-Off Period)
If you are a consumer within the meaning of the Austrian Konsumentenschutzgesetz (KSchG) or the EU Consumer Rights Directive (Directive 2011/83/EU, implemented in Austria through the Fern- und Auswaertsgeschaefte-Gesetz, FAGG), you have the right to withdraw from your subscription contract within 14 calendar days of purchase without giving any reason. To exercise this right, you must send a clear and unambiguous statement of withdrawal (e.g. by email) to: Media4you Internet Services GmbH, support@ivttv.com, within the 14-day period. Please include your account email address and the date of purchase. You may use the model withdrawal form set out in Annex I Part B of Directive 2011/83/EU, but it is not mandatory. Upon valid withdrawal, we will refund all payments received from you within 14 days of receiving your withdrawal notice, using the same payment method you used for the original transaction. No fees will be charged for the refund. IMPORTANT — loss of withdrawal right for digital content: In accordance with Section 18 (1) item 11 FAGG (implementing Article 16(m) of the Consumer Rights Directive), the right of withdrawal does not apply to digital content delivered not on a tangible medium (i.e. streaming) if (i) you have given your prior express consent to begin performance before the expiry of the withdrawal period, AND (ii) you have acknowledged that you thereby lose your right of withdrawal. When you begin streaming any content (e.g. by clicking Play) during the 14-day cooling-off period, you expressly consent to immediate performance and acknowledge that you waive your right of withdrawal for that content.
